Georgia Worker’s Death at Hyundai “Manufacturing Megasite” Raises Questions about Decatur Worker Protections under Georgia Workers’ Compensation Laws

A second worker has been killed at the Hyundai Motor Group Metaplant America (HMGMA) located in Bryan County, Georgia, and some Georgia workers, including those in Decatur, are wondering what protections injured workers and their families have under Georgia workers’ compensation laws. According to local news reports, earlier this year in March, a male employee (who has not been identified to the public as of the time of the most recent reports on the incident) is believed to have been “struck by a forklift” and killed. HMGMA Communications and Public Relations Manager Bianca Johnson explained the terrible and fatal workplace accident, stating, “Around 4:45 p.m. today, an incident occurred at the battery joint venture property on the megasite. The initial indication is that a forklift struck a worker, resulting in fatal injuries to the male victim. The incident is under investigation. HMGMA and our affiliates express our deepest condolences to the individual’s family, friends and coworkers.” The accident occurred at the HMGMA and LG Energy Solutions joint venture battery plant site.
The news of the male worker’s tragic death caused by the forklift accident comes on the heels of another terrible workplace accident at the HMGMA megasite. Just over two years ago, on April 29, 2023, 34-year-old Georgia worker Victor Javier Gamboa Cagiga was killed after he fell from a structure at the worksite. In addition, the Savannah Morning News reported that Bryan County EMS has “responded to more than 90 emergency calls at the metaplant between January 2023 to August 2024.”
Decatur Workers and Their Families Have Rights Under Georgia Workers’ Compensation Laws
In light of the terrible and fatal forklift accident that recently took the life of the male employee at the HMGMA plant, and the other recent accident that took the life of another worker back in 2023 at the same worksite, Decatur workers and their families may be wondering what their rights and options are under Georgia workers’ compensation laws. Under Georgia workers’ compensation laws, Decatur workers who have been injured on the job, and who are unable to return to their regular work due to their work injury, may be entitled to important workers’ compensation benefits. These benefits may include wage replacement compensation benefits, medical expense reimbursement, and vocational rehabilitation services. In addition, in the case of a fatal workplace accident, certain dependent family members of the worker who was killed on the job may be entitled to workers’ compensation death benefits. In order to determine whether you may be owed workers’ compensation benefits in Decatur, it is best to speak with an experienced Decatur workers’ compensation lawyer about your case.
