My Case Seems “Small & Simple”: Can I Just Submit a Claim? Your Questions about Georgia Workers’ Compensation Answered

QuestionMarks

When a serious workplace accident happens in Decatur, injured Decatur workers may wonder what they need to do to get important Georgia worker’s compensation benefits, especially if they think that they have a “small and simple” claim. One such injured worker took to the popular social media forum-style platform, Reddit, to ask about his own workplace injury case. Reddit user “Tonitz” posted to the Reddit forum “WorkersComp” about his workplace injury story. Tonitz stated that:

“I suffered an injury (not being specific for anonymity purposes) on the job while out driving. I finished my shift, and I let my manager know about the injury when I got back. I showed him the injury, and asked how bad it looked. He said it looked pretty bad. He did not make a written note of it, but I know he won’t dispute that we had that conversation. It wasn’t something I considered a serious emergency, but my condition worsened over time, which I found out is normal with this type of injury. I was off work the next day, and went to work the day after. I was really struggling with pain and it was hard to do my job towards the end of the day. I called in sick the next day (which was yesterday), got the workmans comp insurance forms from my manager and went to urgent care. They seemed unprepared to treat my situation and referred me directly to the ER. ER did some tests, gave me some meds, and referred me to a specialist today. So [sic] I had to call out of work today as well. But ER seemed to think it’s nothing serious, barring some unusual findings by the specialist.” Tonitz added, “I’ve done a little bt [sic] of research today about workmans comp. This seems like a very small & simple claim. Should I just try to go directly through my job and their insurance? And if they try to deny it, file through the court but without a lawyer? Any other tips/info much appreciated!”

A “Small & Simple” Claim can be a Complex Claim

Many injured workers in Decatur likely have the same question that Tonitz posed: do I need a lawyer for my “small and simple” workers’ compensation claim? The truth of the matter is that while an injured workers’ workers’ compensation claim may seem “small and simple” at first, the Georgia workers’ compensation system can be complex, and navigating it for the first time alone without a lawyer is not advisable. Accordingly, even if you think that your claim is “small and simple,” it is best to speak with an experienced Decatur workers’ compensation lawyer about your case, as soon as possible after a serious workplace injury occurs.
